AIRF letter to Member Staff, Railway Board - Implementation of MACP Scheme over Indian Railways – Discrepancies

(i) Board’s letter No.PC-V/2009/ACP/2 dated 10/6/2009(RBE No.101/2009) and dated 29/12/2011  (ii) Board’s letter No. PC-V/2011/M/3/AIRF dated 25/2/2014 The Modified Assured Carrier Progression scheme (MACPS) came into effect in terms of RBE No.101/2009 dated 10/6/2009 modifying the ACP scheme already invogue before this scheme. The Railway Board’s letter supra gives detailed provisions of MACPS as also clarifies a numbers of related issues. The illustration on page No. 9 of the said letter states at (a) under Para 28 that  “in case  an employee  had earned first promotion within a period less than  10 years , say in 8 years of regular service and then  continues  in same grade pay for further 10 years,...

Finance minister approves CBEC cadre restructuring

The Union finance minister has finally approved the cadre restructuring in the central board of excise and customs (CBEC). The cadre restructuring was in the pipeline for seven years. With the approval, over 18,000 new posts are expected to be created in the department across the country. In Gujarat, four new commissionerates are likely to be added in the Ahmedabad zone. Presently there are 10 commisionerates of central excise, one of service tax and three commissionerates of appeals in Ahmedabad and Vadodara zones. According to sources, the new commissionerates are expected to be three of audit, one each with Ahmedabad I, II and III commissionerates and a new central excise commissioner in Kutch. At present, Kutch comes under the Jamnagar commissionerate. Meanwhile, no new commissionerates are likely to be added in the service tax or customs in Gujarat. On receipt of this, the National Council JCM Staff Side met on 6th and 7th May 2014 at Delhi and discussed the issues. Brief of subsequent legal issues on Pre-2006 revised pension in various courts

In order to get revised pensionary benefits with effect from 1.1.2006, Pre-2006 Pensioners approached Central Administrative Tribunal again which issued suitable orders to Governement to revise the pension with effect from 1.1.2006. This order was challenged by Government before Hon’ble High Court. However, CAT’s decision was once again upheld by Hon’ble High Court. Government had filed a SLP before Hon’ble Supreme Court against the order of High Court. This SLP was dismissed by Apex Court in the initial stage itslef. This dismissal order of Apex Court was sought to be reviewed by filing Review Petition. The Review Petition was also dismissed by Hon’ble Supreme Court. All these legal battles that had been decided in favour of Pre-2006 Pensioners have proven that it is a genuine case of Pre-2006 Penioners to set right the anomaly in fixation of Pension as per implementation of 6th CPC report between Pre-2006 Pensioners and Post-2006 Pensioners.
